Buying and Selling Property in Italy vs. France

While France and Italy both boast thriving luxury real estate markets, the buying and selling process differs significantly. Understanding these distinctions, including agency commissions, is essential for a smooth transaction in Italy.

In Italy, the property purchase process is highly structured. It begins with a proposta d’acquisto (purchase proposal), a formal offer accompanied by a small deposit. If accepted, a compromesso (preliminary contract) follows, legally binding both parties and requiring a deposit of 10-20% of the purchase price.

This stage allows for due diligence, such as verifying the property’s title and ensuring no outstanding debts. The process concludes with the rogito, a notarised deed of sale signed before a public notary.

In France, the process is more straightforward, typically involving a single compromis de vente (sales agreement) and the final deed, with fewer preliminary steps.

Agency commissions to buy property in Italy

A key difference lies in agency commissions. In Italy, it’s customary for both the buyer and seller to pay commissions to their respective real estate agencies.

These commissions are separate, meaning the buyer’s and seller’s agencies receive their respective fees without splitting a single commission.

In France, commissions are more often paid solely by the seller (typically 5-8%), and buyers rarely pay agency fees unless engaging a buyer’s agent for specialised services such as hiring a buyer broker.

Italian buyers also face additional costs, including a registration tax (imposta di registro), stamp duty, and cadastral taxes, which depend on whether the property is a primary residence or a second home.
