Buying a new build property in the South of France Côte d’Azur
France leads Europe regarding environmentally friendly construction and energy requirements, such as RT 2020. The mandatory energy class for project developers in 2017 was the highest, so all new homes and apartments are built with deficient energy consumption. With intelligent heat pumps and solar panels, you can save much money on energy to heat or light the building.
If you want to buy (or have built) a new villa on the Côte d’Azur, you must take a specific approach. Of course, most new-build developments are luxury apartments. But we do have them: the new villas. In villages like Biot, Cap d’Ail, Mandelieu, Mougins or Saint Maxime.
The best part of buying a newly built villa or apartment is that you can talk to the architect and builders and add some more walls in the way you want. Maybe you want a more oversized bedroom or an extra walk-in closet; things can be added or modified at the drawing stage for a small fee. Find your new-build villa and make it entirely in your style.

Buying process for a new villa or apartment in France
There is no other European country where a buyer is as well protected as in France. From the moment you are interested in buying a newly built apartment, French law is on your side.
When you have seen a specific apartment and agreed on a price with a parking space, garage, or garage box, this price is described on a preliminary purchase contract, also known as a reservation contract. This reservation contract can be signed under power of attorney or in the developer’s office.
Our customers are all from abroad, so it is not uncommon for the decision to buy to be made on the plane on the way home. Your first action will be to confirm by e-mail that you want to buy the new apartment or villa.
You must enclose your passport and your home address with this e-mail. If you are married, the civil-law notary will want to know whether you were married in the community or on a prenuptial agreement. You must also deposit within a week as a sign of goodwill.
Deposit to make the reservation
This deposit is generally 5% of the total price. We will send you the reservation contract by e-mail containing the most critical information, such as the names of the buyer(s), the description and price of the property, and your marital status.
You must print this in triplicate, initial and sign each page, and then we will go over this contract with you over the phone.
More and more notaries and project developers are using a digital reservation system like AR-24 or Docusign. The type varies slightly, but we will help you through the procedure.
Meanwhile, when your 5% deposit arrives in France, the developer will know that you are serious about the purchase. The contract is now signed by the project developer’s representatives.
By post or registered e-mail
You have another ten days to cancel the sale from the date you sign for receipt of the certified documents.
Do you want to cancel the purchase within ten days? No problem. You can send a registered letter and email to the project developer, and the money will be refunded within two months. You have another 60 days to find a mortgage when the ten days pass.
You can cancel the sales contract if you don’t get a mortgage. To this end, proof of two, sometimes a bank rejection, must be sent to the developer. You will receive your deposit back and will not have to pay any costs.
Guaranteed delivery
We all know the stories from the past where the project developer accepted your money with a smile and then left with the Noorderzon. Fortunately, times have changed; the down payment is made to the notary’s bank account, who also ultimately draws up the purchase contract.
During the progress of the new construction, the architect checks each completed construction phase. He/she gives his/her approval to the project developer, who then informs the buyer with a request to pay the next part.
The partial payments go directly to the project developer, up to the last 5%, which you only pay after the house inspection.
In the unlikely event the project developer goes bankrupt during construction, that is not a problem for you. With special insurance that functions as a Guarantee Fund, the progress of the new building is guaranteed, and you will receive the key on the agreed date, plus all guarantees agreed upon when booking.
To the notary in France
You will receive an invitation to sign at the notary as soon as you have a mortgage or the money. Depending on the last delivery date, this moment can occur between 1 and 6 months later.
The final contract is the same as the preliminary purchase contract at the notary. But now it’s real; you get the actual contract, a payment schedule, and usually, a bottle of champagne to celebrate that you are now part of the group of bon vivant in the most beautiful place in Europe: la Côte d’Azur!
